A suburban Cleveland man has been convicted a second time of murder and felonious assault in his retrial in connection with the 2009 fatal beating of 23-year-old Kent State University student Christopher Kernich.
The Beacon Journal reports Adrian A. Barker, 25, was sentenced to 15 years to life by Portage County Common Pleas Judge John Enlow.
Barker won a new trial early last year, when an appeals court overturned his 2010 jury convictions along with his prison sentence. His attorneys had successfully argued that Enlow had failed to give that jury instructions on lesser included charges of manslaughter and reckless homicide.
Enlow did include those charges this time in his instructions to the jury..
