It looks like a fired Norton cop has a shot at getting his job back.
Nicholas Matheny lost his job with the Norton Police Department shortly after his wedding invitations revealed that he would become Muslim. Matheny filed suit, saying that the city denied him a contractual right to arbitration. The city contends that the normal grievance procedure does not apply to probationary employees, then argued that Matheny gave up the right when he filed a lawsuit against the city. The 9th District Court of Appeals diced up the complaint and offered a mixed ruling, but did say that a Summit County judge erred when she ruled in favor of the city. The case is now being sent back for further consideration.
