Cooey was still waiting to hear from the U.S. Supreme Court on a separate appeal. In that case, the Ohio Supreme Court on Monday denied Cooey's request that the state use a single drug in the lethal injection process instead of a three-drug combination that he says could cause an agonizing and painful death.
