UPDATE AUDIO High Court Denies Cooey's Stay Request 10/9/2008 10:02:26 AM | Joe Jastrzemski The Ohio Supreme Court has denied the Stay of Execution Request made by attorneys for Richard Cooey. advertisement Cooey's attorneys had asked for the Stay stating that death by lethal injection, given Cooey's condition, would produce an agonizing death, which violates constitutional and statutory obligations.
Ohio Attorney General's Office Spokesman Jim Gravell says Cooey still has an appeal pending in the 6th US Circuit Court of Appeals. AkronNewsNow contacted the Ohio Public Defenders Office, who is representing Richard Cooey. While refusing to go on tape, attorneys say they are anticipating an appeal to the US Supreme Court, whether they win or lose in the 6th Circuit.
Cooey's execution date is October 14th. Gravell says lawyers from the Attorney General's Office are ready at a moment's notice to argue the case in whatever court its filed in. Summit County Prosecutor news release"With the Ohio Supreme Court's denial of Richard Cooey's motion for a stay of execution, we are one step closer to putting an end to his 22-year legal battle," Prosecuting Attorney Sherri Bevan Walsh said. "We are still awaiting a decision from the U.S. Court of Appeals, 6th Circuit, where Cooey has also filed a motion for a stay of execution. We are hopeful their decision will not delay Cooey's execution, which is scheduled for next Tuesday."
Within the last two days, Cooey has also filed a brief "on the merits" of his legal issues, (i.e, vein accessibility and that prison food has made him overweight) with the 6th Circuit; he also filed a motion of stay for his execution. These two motions are still pending and the response is being handled by the Ohio Attorney General's Office.
Prosecutor Walsh continued, "Richard Cooey is running out of cards to play. In 1986, he viciously and senselessly raped and murdered two bright, vibrant young women who were attending the University of Akron. Cooey devastated countless people that day "“ altering forever the lives of those who knew and loved Wendy Offredo and Dawn McCreery "“ and has spent more than two decades since trying to escape his punishment."
"Richard Cooey was, and is, a monster. He has shown no remorse and has never taken any responsibility for his actions on that tragic day in 1986. We are getting closer to ending this aspect of the nightmare for Wendy and Dawn's family and friends and will continue to do our part to support his execution on Tuesday, October 14."

You have brought out such ire in me because after all of this time of eating the food, having a roof over your head, and having clothes that my tax money went for all you came up with is how to try and beat the system. You had the opportunity to come to some sort of responsibility for your crime and in your final days all you tried to do is blame the other piece of crap for the crime. You had enough nerve to try and blame the taxpayers for being fat because of the kind of food that prison has fed you. You are lucky to have ate at all.
