Lawsuit Challenges Lethal Injection In Ohio 9/19/2008 3:14:34 PM | Craig Simpson The state public defender's office says Ohio's method of executing prisoners is unconstitutional. advertisement The lawsuit filed Thursday in Columbus comes just weeks before the scheduled Oct. 14 execution of Richard Cooey, who was convicted of killing two college students in 1986. The lawsuit was filed on behalf of Cooey and 15 other inmates on death row. Kelly Schneider, an attorney in the public defender's office, says the lawsuit is based on a ruling by a judge in Lorain County, who said in June the state should use a single, anesthetic drug instead of a three-drug combination.
