ECONOMY SERIES: AUDIO Covering Child Support Payments

A change of income can play a role in how much child support one must pay.

While the usual requirement for an income review request is granted after 30 days of unemployment, the Summit County Child Support Enforcement Agency (CSEA) is helping those laid off.
 
John Galonsky, assistant prosecuting attorney for CSEA, explained the 30-day waiting period is being waived for parents in certain situations.

"If there's a mass layoff, which is defined as basically 30 percent of the workforce, or there's a plant closing, then the person would have a right to request an immediately," he explained.

 
 
To start the process, the parent must contact their caseworker to request the review. If the order to review is approved by the court, a lawyer doesn't have to be involved in the process. Galonsky explained more than just income is factored into the final decision.

"It's income, do they have other child support obligations, do they have other child that they didn't have when the order was established, so those are the basic criterias," he explained.

After the recommendation is make, it's submitted as a new order. Only if each party rejects the court's recommendation, will the case go before a judge.

"When there's a loss of income, it's tough on everyone," he said.

If an individual becomes unemployed, the CSEA can automatically withdraw the child support payments from their unemployment benefits. Health Insurance is also factored into the equation.

Even if an individual isn't currently laid off or jobless, preparing for what could potentially happen is advised by Galonsky. Keeping in contact with the assigned caseworker is his best advice.

"All situations are different, but to be in contact with the CSCA and it would actually create a better environment for everybody," he said.
